1. About this policy

Rad Mod Cons (ABN 35 693 151 343) is an Australian-owned online retailer based in Mooloolah Valley, Queensland. We operate the website radmodcons.com. In this policy, “we”, “us” and “our” refer to Rad Mod Cons.

This policy explains how we collect, use, store and disclose personal information when you visit our website, shop with us, contact us or otherwise interact with us.

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether it is recorded in a material form or not.

We handle personal information in accordance with applicable Australian privacy law and this policy. The Privacy Act 1988 (Cth) applies to organisations that are APP entities; whether an organisation is covered can depend on its circumstances, including any small-business exemption or exception. We aim to handle personal information consistently with the Australian Privacy Principles (APPs). Queensland’s Information Privacy Act 2009 primarily applies to Queensland public-sector agencies and may apply to certain service providers handling information for those agencies; it does not generally regulate ordinary private-sector retail activities.

2. Personal information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact details, such as your name, email address, phone number and billing or delivery address.
  • Account details, such as login or account preferences, if you create an account.
  • Order and transaction details, such as products purchased, order history, delivery instructions, returns and refunds.
  • Payment information, such as payment method and transaction confirmation. Payments are processed by the relevant payment provider or wallet service. We do not intentionally store full card numbers or security codes on our own systems.
  • Communications, such as messages, enquiries, feedback and records of our contact with you.
  • Marketing preferences, including whether you have subscribed to marketing messages or opted out.
  • Website and device information, such as IP address, browser type, device information, pages viewed and interactions with our website. This may be collected through cookies and similar technologies.
  • Information you choose to provide, such as product reviews, social media interactions or competition entries.

We generally do not seek sensitive information. Please do not provide sensitive information unless we ask for it and explain why it is needed. If we need to collect sensitive information, we will do so only where permitted by law and, where required, with your consent.

3. How we collect personal information

We may collect personal information:

  • directly from you when you place an order, create an account, sign up for emails, contact us, submit a review or enter a competition;
  • automatically when you browse or use our website, including through cookies and analytics technologies; and
  • from service providers involved in operating our store or fulfilling your order, such as Shopify, payment providers, shipping carriers (including Australia Post) and marketing or analytics providers.

If we receive personal information we did not ask for, we will assess whether we could have collected it under the APPs. If we could not have collected it, we will take reasonable steps to destroy or de-identify it, where lawful and reasonable to do so.

4. Why we collect and use personal information

We collect and use personal information where reasonably necessary to:

  • process, fulfil, deliver and support your orders;
  • process payments, refunds, returns and exchanges;
  • communicate with you about orders, accounts, enquiries and service updates;
  • send marketing and promotional messages where you have consented;
  • personalise and improve our website, products and customer experience;
  • maintain website functionality, detect fraud and protect the security of our store;
  • meet our legal and regulatory obligations, including tax, accounting and record-keeping requirements; and
  • carry out another purpose notified to you when we collect the information, or otherwise permitted or required by law.

Where we ask for information that is necessary to provide a service or complete an order, and you choose not to provide it, we may be unable to provide that service or fulfil that order.

5. Who we disclose personal information to

We may disclose personal information to service providers and other recipients where reasonably necessary for the purposes described in this policy, including:

  • Shopify, which hosts and supports our online store;
  • payment providers and wallet services, such as Shopify Payments, Afterpay, PayPal, Apple Pay and Google Pay, as applicable to your chosen payment method;
  • shipping and delivery providers, including Australia Post, to deliver your order;
  • IT, website, analytics and marketing service providers who help us operate and improve our business;
  • our professional advisers, where necessary; and
  • regulators, law-enforcement agencies or other authorities where required or authorised by law.

We do not sell personal information.

Third-party providers may handle your information under their own privacy policies. We encourage you to review those policies where relevant to your use of their services.

6. Overseas disclosure

Some of our service providers, or their related entities and subcontractors, may be located outside Australia. Depending on the services used, personal information may be stored or accessed in countries including the United States, Canada, Ireland and other countries.

Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it in a way that is consistent with the APPs, where required by law. In some circumstances, Australian law may treat us as having disclosed the information ourselves if an overseas recipient mishandles it.

7. Cookies and analytics

Our website and Shopify may use cookies and similar technologies to help the store work, remember preferences, understand website use and support marketing.

These technologies may include:

  • essential cookies, which support core website functions such as checkout and security;
  • analytics cookies, which help us understand how visitors use the website; and
  • marketing cookies, which may help deliver or measure relevant promotions.

You can manage or block cookies through your browser settings. If our website displays a cookie banner or settings tool, you can also use it to manage available choices. Blocking some cookies may affect website features or checkout.

Where the law requires consent for a cookie or similar technology, we will seek that consent. Simply continuing to browse our website does not constitute consent where affirmative consent is required.

8. Direct marketing

We send direct marketing messages only where we have obtained your consent or where otherwise permitted by law. For example, you may choose to subscribe to our emails, including to receive our 5-10% off first-order offer.

Every marketing message will identify us and include a way to unsubscribe. You can opt out at any time by using the unsubscribe link or contacting us at hello@radmodcons.com. We will process your request as soon as practicable.

Opting out of marketing will not stop essential, non-marketing communications, such as order confirmations, delivery updates or responses to your enquiries.

9. Accessing and correcting your information

You may ask us for access to personal information we hold about you, or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, email hello@radmodcons.com and tell us what information you are seeking or what needs correcting. We may need to verify your identity before responding. We aim to respond within a reasonable period and, where practicable, within 30 days.

In limited circumstances permitted by the APPs, we may refuse access or decline to make a requested correction. If we do, we will explain our decision and, where appropriate, how you may request a review or have a statement associated with the information.

10. Data security and retention

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps may include using secure hosting and service providers, limiting access to people who need information for their work, and using payment providers to process payment details.

No method of electronic storage or transmission is completely secure. We cannot guarantee absolute security, but we take reasonable steps to protect the information we hold.

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, including to provide services, resolve disputes and meet legal obligations. Some tax, accounting and business records must be retained for at least five years, and some records may need to be kept longer. When personal information is no longer needed and we are not legally required to keep it, we take reasonable steps to destroy or de-identify it.

11. Notifiable data breaches

We take data breaches seriously. If we become aware of a suspected eligible data breach, we will take reasonable steps to assess it and limit any harm.

Where the Notifiable Data Breaches scheme applies and we have reasonable grounds to believe an eligible data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable, as required by law. The notification will include information required by law, such as a description of the breach, the kinds of information involved, recommended steps individuals can take, and our contact details.

The Privacy Act requires a reasonable and expeditious assessment of suspected eligible data breaches, generally completed within 30 days after we become aware of grounds to suspect a breach may be eligible.

12. Anonymity and pseudonymity

You can generally browse our website without identifying yourself. Where available, you may also be able to check out as a guest rather than create an account.

To place and deliver an order, we need information such as your name, contact details and delivery address. We may not be able to provide some services anonymously or under a pseudonym where it is impracticable or unlawful to do so.

13. Complaints

If you have a concern about how we have handled your personal information, please contact us at hello@radmodcons.com with “Privacy complaint” in the subject line. Please explain what happened and how you would like us to address it.

We will acknowledge and investigate your complaint and aim to respond within a reasonable period, usually within 30 days. If you are not satisfied with our response, or we have not responded within a reasonable time, you may complain to the OAIC at oaic.gov.au or by calling 1300 363 992.

Nothing in this policy limits your rights under applicable Australian privacy law.

14. Children

Our store is intended for a general audience and is not directed at children under 15. We do not knowingly collect personal information from a child under 15 without appropriate parent or guardian involvement.

If you believe a child has provided us with personal information, please contact us. We will assess the request and take reasonable steps to delete the information where appropriate and where we are not required by law to retain it.

15. Changes to this policy

We may update this policy from time to time to reflect changes to our practices, services or legal obligations. We will publish the current version on our website and update the “Last updated” date above.
